Experience Umpqua LLC Terms & Conditions and Liability Waiver

By booking a tour with Experience Umpqua LLC (“Company”), the person completing the booking (“Participant” or “Booking Party”) confirms that they have read, understood, and agree to the following Terms and Conditions and Liability Waiver. This Agreement applies to all individuals in the booking party.

1. Acceptance on Behalf of Group

By completing this booking, the booking party affirms that all participants in their group have been informed of, and agree to, these Terms and Conditions and this Liability Waiver. The booking party accepts full responsibility for communicating these terms to all members of their party. The booking party also agrees to accept financial responsibility for any fees or damages arising from their group’s participation.

2. Assumption of Risk

Participant understands that wine tours involve inherent risks, including but not limited to travel in vehicles, consumption of alcoholic beverages, and activities at third-party locations. The Participant voluntarily assumes all risks, whether foreseen or unforeseen, related to these activities.

3. Release of Liability

Participant agrees to release, waive, and discharge the Company, its members, employees, contractors, agents, and affiliates from any and all claims, liabilities, or damages arising out of or in connection with participation in the tour, including but not limited to personal injury, property damage, or loss.

4. Indemnification

Participant agrees to indemnify and hold harmless the Company and its representatives from any claims, damages, or expenses (including attorneys’ fees) resulting from Participant’s actions or conduct during the tour.

5. Alcohol Consumption

Participant acknowledges that any decision to consume alcohol is voluntary and at their own discretion. The Company is not liable for any injury, loss, or damage resulting from Participant’s alcohol consumption or any related actions.

6. Right to Refuse Service or End Tour

The Company reserves the right, at its sole discretion, to terminate the tour or refuse service to any participant whose behavior is disruptive, unsafe, or excessively intoxicated. No refunds will be issued in such cases.

7. Third-Party Venues

The Company is not responsible for any incidents, actions, or conditions at third-party venues visited during the tour.

8. Excessive Cleaning Fee

If a participant causes damage to the vehicle or leaves an excessive mess (e.g., spills, vomit, soiling), a $200 cleaning fee will be charged to the card used to book the tour.

9. Photo & Video Release

Photos and videos may be taken during the tour for marketing and promotional purposes. By participating, you grant permission to Experience Umpqua LLC to use these images without compensation unless you explicitly notify us in writing before or at the beginning of the tour. To opt out, please email us at info@experienceumpqua.com or inform your guide prior to the tour.

10. Governing Law

This Agreement shall be governed by the laws of the State of Oregon. If any provision is found unenforceable, the remainder of the Agreement shall remain in effect.

By completing your booking, you agree to the terms above on behalf of yourself and your party.
